Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your use of the AI METABOLICAweb application (“the Service”), provided by VLCroup, LLC (a Delaware limited liability company)(“we”, “us”, “the Company”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

AI METABOLICA provides:

  • Meal tracking and calorie/macro counting
  • AI-based food recognition from photos
  • An AI chat and voice nutrition assistant (“Margarita”)
  • Food database search and barcode scanning
  • Progress statistics, a calendar, and a community feed
  • Optional menstrual-cycle tracking and body-progress photos (separate consent required)

3. Accounts

  • You must be at least 16 years old to create an account.
  • Information you provide must be accurate and kept up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • We may suspend or terminate accounts that violate these Terms.

4. Subscriptions and payments

4.1. Plans

  • FREE — limited functionality, no cost.
  • PRO — $4.99/month or $47.90/year.
  • PREMIUM — $9.99/month or $95.90/year, full access and priority support.

Current pricing is shown at checkout and on our pricing page, and is subject to change under §4.4 and our Subscription & Refund Policy.

4.2. Payment processor

Payments are processed by Stripe. We never store your full card details.

4.3. Automatic renewal and cancellation

Subscriptions renew automatically for the same billing period (monthly or annual) until cancelled. You can cancel anytime through the Stripe Customer Portal; access continues until the end of the paid period.

4.4. Refunds and price changes

Refunds are governed by our Subscription & Refund Policy, including the statutory EU/EEA/UK 14-day withdrawal right. We may change prices with notice as described there.

5. Acceptable use

You agree not to:

  • Violate any applicable law
  • Upload malware or attempt unauthorized access to our systems
  • Use bots or automated means to abuse the Service
  • Impersonate another person
  • Post unlawful, abusive, or otherwise objectionable content in the community feed
  • Resell or sublicense access to the Service
  • Reverse-engineer or copy the Service’s code or design

6. AI features — important disclaimer

⚠️ IMPORTANT WARNING

  • • Our AI assistant and photo-recognition features provide general informational content only
  • • They are NOT medical advice, diagnosis, or treatment
  • • Nutrition and calorie estimates may be inaccurate
  • • Always consult a qualified physician or registered dietitian before changing your diet or starting an exercise program
  • • If you have a medical condition (diabetes, an eating disorder, food allergies, etc.), consult a specialist
  • • Do not disregard professional medical advice because of something you read or were told by the Service

7. Intellectual property

7.1. Our rights

We own all rights to the Service, including its design, code, and the “METABOLICA” name and logo. You may not use them without written permission.

7.2. Your content

You retain ownership of content you create (food photos, chat messages, profile data). By submitting content, you grant us a license to use it solely to provide and improve the Service.

8. Limitation of liability

  • The Service is provided “as is” without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages, or for lost data or lost profits
  • Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim
  • We are not responsible for the acts of independent third parties (OpenAI, xAI, LogMeal, FatSecret, Stripe, etc.)
  • Nothing in these Terms limits liability that cannot be limited under applicable law

9. Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

10.1. By you

You may delete your account at any time from Profile settings. Data is deleted within 30 days, except where retention is legally required.

10.2. By us

We may suspend or terminate your access for violation of these Terms, fraud, or other serious misconduct.

11. Changes to these Terms

We may update these Terms. We will notify you of material changes by email or in-app notice at least 30 days before they take effect where feasible. Continued use after changes take effect constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of State of Delaware, United States of America, without regard to conflict-of-law principles, except where mandatory consumer-protection law of your country of residence provides otherwise.

We will attempt to resolve disputes informally first; unresolved disputes are subject to the exclusive jurisdiction of the courts of State of Delaware, United States of America, unless local law grants you the right to bring a claim in your own jurisdiction.
